Trademark Office – State Administration for Industry and Commerce (CTMO)

The Trademark Office under the State Administration for Industry and Commerce is in charge of the registration and administration of trademarks nationwide, specifically responsible for such issues as follow: registering good marks, service marks, collective marks, certification marks and so on; dealing with oppositions to registered trademarks and other matters concerning modification, assignment, renewal, cancellation of registered trademarks and reissue of trademark certificates; providing guidance to local administrative authorities for industry and commerce (AICs) in handing trademark infringement and counterfeiting cases; determining and protecting well-know trademarks in accordance with law; supervising the operation of trademark agencies; working out regulations and concrete measures in respect of trademark registration and administration; implementing international trademark treaties and agreements in China and undertaking the international exchanges and cooperation in the field of trademark.

China International Economic and Trade Arbitration Commission

The China International Economic and Trade Arbitration Commission (CIETAC) is the most important permanent arbitration institution in China. Formerly known as the Foreign Trade Arbitration Commission, the CIETAC was set up in April 1956 under the China Council for the Promotion of International Trade (CCPIT) to meet the needs of the continuing development of China’s economic and trade relations with foreign countries after the adoption of the “reform and opening-up” policy, the Foreign Trade Arbitration Commission was renamed as the Foreign Economic and Trade Arbitration Commission in 1980, and then finally settled down as the China International Economic and Trade Arbitration Commission in 1988. Since 2000, the CIETAC is also known as the Arbitration Court of the China Chamber of International Commerce (CCOIC).

The CIETAC independently and impartially resolves economic and trade disputes by means of arbitration and conciliation (mediation).

The CIETAC‘s headquarters is located in Beijing with two sub-commissions in Shanghai and Shenzhen, respectively known as the CIETAC Shanghai Sub-Commission and the CIETAC South China Sub-Commission. In order to meet the needs of the development of the arbitration practices, the CIETAC also successively established 19 liaison offices in different regions and specific business sectors to provide parties with handy arbitration advice.

After nearly 50 years of continuous endeavour, the CIETAC is now one of the busiest arbitration centres in the world. With its arbitration practices and academic activities, the CIETAC has also made great contributions to the legislation of the Chinese arbitration law and the development of the arbitration practice in China. Not only does CIETAC maintain positive relations and cooperation with all the major arbitration institutions throughout the world, it also upholds a respectable reputation at home and abroad for its independence, impartiality and efficiency.

CFTC is an institutional unit directly led by the Ministry of Commerce of the People’s Republic of China. CFTC is a professional Exhibition sponsor with rich experience, and its Exhibition history can be traced back to 1957, the starting year of China’s Exhibition industry. In the same year, the First session of China Import and Export Fair (also called the Canton Fair) was held, and the Exhibition Hall of Canton Fair, the predecessor of CFTC, was founded.

CYBER-FRAUD COMPLAINTS BEYOND CHINA’S BORDERS

Obviously if you have, or believe you have become the victim of a criminal act, you should file a complaint with local police in the area of China where the perpetrators state they are operating and/or their website is located. Additionally, the Internet Crime Complaint Centre would be another good option. It shouldn’t really matter what country you are in your complaint should be taken seriously.

Cyberfraud.org.uk is a public service dedicated to protecting the consumer from becoming a victim of Internet fraud and Identity theft. This is the only site in the UK to provide a central platform covering all aspects of cyber crime.

Their aim is to increase the level of public awareness of cyber fraud by lobbying Government for changes in legislation and better statistical information about the true levels of cyber crime in the UK.
